Public Hearing for Proposed Amendments to the 2019 Affordable Housing Rules

Pursuant to §§ 91-3 and 92-41, Hawaii Revised Statutes (“HRS”), notice is hereby given that the Department of Planning and Permitting (“DPP” or “Department”) will hold a public hearing to consider the amendment and compilation of the Rules to Implement City’s Affordable Housing Requirements (2019) (“AHR Rules”). The purpose of the proposed amendments is to modify the maximum permissible rents of for-rent affordable housing units governed by the AHR Rules and the eligibility requirements for affordable, for-sale housing units. The hearing will be held at the following time and location:

A brief description of the proposed rule amendments is provided below:

§ 2-12 Affordable Rental Unit Rates

Amends subsection (c) by clarifying that for-rent affordable housing projects that have an affordable housing agreement in place on the effective date of the proposed rule are excluded from the proposed rule amendments.

Replaces subsection (d) of the existing Rules with a new subsection (d) that establishes a new maximum monthly rent applicable to for-rent affordable housing units that do not have an affordable housing agreement in place on the effective date of the proposed rule.

Renumbers subsections (d).

Renumbers subsection (e) and amends the text of subsection (e) to eliminate rent price adjustments according to the number of bedrooms.

§ 3-2 Eligibility Requirements: Affordable For-Sale Housing Units

Deletes paragraph (a)(5), requiring proof of sufficient gross monthly household income to qualify for financing, in the entirety.

Renumbers paragraphs (a)(6) to (a)(8).
