A. Kailua NB Committee Meetings will be in recess in December and resume in January. Kailua NB regular meeting will be in recess in January and resume on February 6, 2025.

III. BOARD VACANCY – For the term ending June 30, 2025: Sub-District 4 (Coconut Grove, Aikahi, Kailua Town). Board members may nominate candidates to fill the vacancy. Proof of Sub-District residency is required. Candidates may speak for three minutes prior to Board voting.

VI. BOARD BUSINESS: COMMITTEE MOTIONS
A. The Kailua Neighborhood Board recommends that the following conditions be added upon approval of an SMA application for 111 Kailuana Loop.
a. If iwi kupuna are found the burial treatment plan must meet the standards of HRS 13-300-33.
b. Prohibit artificial light from exterior light fixtures from directly illuminating or projecting across property boundaries toward the shoreline and ocean waters, except as otherwise permitted by HRS 205A-7.1(b).
(1) Require that all exterior light fixtures to be fully shielded.
(2) Require exterior lighting to be turned off when human activity is not occurring in the illuminated area
c. All Project site work and construction activities are limited to daylight hours (from sunrise to sunset) to avoid collisions and fatalities during seabird fledging season from September 15 through December 15.
d. A visual survey for seabirds and burrow nests must be conducted prior to any construction activities.
e. If a burrow nest is discovered, work will cease within a minimum radius of 200 feet of the nest for a minimum of 100 to 115 days.
f. If Wedge-tailed Shearwater or any sea bird nests or burrows are found, sometime between late October through the end of November, work must be discontinued for 100 to 115 days until all fledging’s have left their nests.
g. Landscaping must not extend seaward of the shoreline as depicted in the current certified shoreline survey for the shoreline lot, or in the event there is no current certified shoreline survey for the lot, seaward of the shoreline as defined in HRS 205A.
h. Require the landowner to acknowledge that “bed and breakfast homes and transient vacation units”, as defined in ROH Chapter 21, the LUO, are not allowed.
i. Require the landowner to acknowledge that “land makai of the regulatory shoreline is State public land within the State land Use Conservation District” and must remain available for public use and recreational activities.

B. The Kailua Neighborhood Board requests that the City and County of Honolulu establish standardized beach information and warning signs at all City and County beach parks. A comprehensive sign should be placed at each park entrance and near each lifeguard station to include hazardous currents and shore breaks and current conditions including wave heights, jellyfish advisories, brown water advisories, shark sightings, turtle or monk seal cautions, and beach hours. Such beach signs should be updated on a daily basis as needed.
These signs don’t have to be fancy – a durable signboard such as those the state uses for highway signs with smaller boards for each current condition would suffice. Uniformly placing such signs at each beach park entrance and near lifeguard stands would greatly help public awareness and expectations, as current advisories are typically haphazard, ad hoc, and often missing, leaving the public generally unaware.
The signs could be updated by the lifeguard at beaches where lifeguards are assigned. At beaches that do not have lifeguards, the signs could be updated daily if needed by the Parks Department.

C. The Kailua Neighborhood Board supports the formation of a Permitted Interaction Group (PIG) to investigate the possibility of a landfill in Kailua.

D. Resolution Urging the Legislature to Adopt Good Government Reforms:
WHEREAS the Kailua Neighborhood Board is a citizens’ advisory board whose purpose is to “increase and assure effective citizen participation in the decisions of government”; and
WHEREAS although the Hawaii State Legislature convened the Commission to Improve Standards of Conduct (CISC) in 2022 “for the purpose of reforming basic underpinnings of our state governance, specifically the laws surrounding corruption, lobbying, ethics, and campaign spending”, during the legislative sessions that followed the CISC’s issuance of its final report, legislators failed to act on its most impactful proposals, including increasing safeguards on campaign contributions, prohibiting unilateral power to kill bills, allowing public immediate viewing of testimony, improving public financing of elections, and allowing the public to vote on term limits for legislators; and
WHEREAS the legislature adopts its own rules of operation because the Hawaii Constitution contains very few requirements and has the authority to implement rules changes to make itself more transparent and ethical; and
WHEREAS both the House and Senate have adopted rules that give committee chairs the power to decide which bills referred to their committees receive hearings, and which do not; and
WHEREAS the rules regarding the releasing of the testimony only require release at the time of the hearing, which impedes committee members and the public from gaining a better understanding of the issues prior to the hearing; and
WHEREAS bills that do not create or expend funds (non-fiscal bills) are often needlessly referred to the House and Senate finance committees, creating an insurmountable backlog and inevitably giving chairs the authority to defer bills not in their purview; and
WHEREAS co-sponsorship of bills promotes collaboration and ensures that bills with board support receive proper consideration and ensuring popular bills can’t be blocked by leadership; and
WHEREAS bills can be substantially amended without prior notice or public discussion, and amendments in writing provide clarity for the public but also for the legislators themselves, along with assuring all amendments are voted on in public; and
WHEREAS bills introduced by request do not always include disclosure of the entity that made the introduction and allow lawmakers to be inculpable; and
THEREFORE, BE IT RESOLVED that the Kailua Neighborhood Board respectfully urges the legislature to pass the following amendments to the House and Senate Rules before the 2025 Legislative Session:
1. Each committee shall make all testimony it receives immediately available for public review – at least 22 hours before the hearing, and at least 2 hours before the hearing for “late” testimony;
2. Each committee shall vote on the disposition of all bills referred to the committee and shall not use “deferrals” as a means of hiding committee member positions on bills;
3. Bills that do not create or expend funds (non-fiscal bills) shall not be referred to finance committees;
4. Amendments to bills must be in the possession of all committee legislators before the amended version of the bill can be voted on;
5. Bills introduced “by request” must include a disclosure of the entity that made the request;
6. Enact term limits on Chair and Leadership Positions to curb the outsized and corrupting power that such positions can accumulate over time.
BE IT FURTHER RESOLVED that copies of this resolution be transmitted to the Governor of Hawai’i, members of the 2025 Hawai’i State Legislature, and all Neighborhood Boards.

Playground Vandalism [1:14:25]: Resident Ashley Masarik raised concerns about the playground at Kailua District Park, next to the gymnasium. The playground has been vandalized with inappropriate drawings and racist pictures. The swings and spinning apparatus have been removed without replacement.

Mayor Rick Blangiardi’s Representative – [1:18:52]: Shayne Enright (Honolulu Emergency Services Department) provided the report and highlighted the following: The City’s Department of Environmental Services (ENV) plans to increase its sewer service charges for all residential and commercial customers in Fiscal Year 2026, which begins July 1, 2025; Restriping work performed in Kailua about October 21, 2024; Brush cutting maintenance began on Thursday, October 24, 2024. Ka’iwa Ridge Trail Master Plan SMA [2:16:00]: Catie Cullison presented the following. Planned changes address safety and runoff concerns. A series of switchbacks are proposed, creating sustainable designs, and reducing sediment transport – resulting in improved nearshore water quality. XII. BOARD BUSINESS: INDIVIDUAL MOTION – [2:40:16]
The Kailua Neighborhood Board requests CIP funding for the hardening and retrofitting of one or more previously designated hurricane shelters, preferentially either Kalaheo High School or Kailua High School.
WHEREAS there used to be eight designated hurricane shelters in Kailua (Aikahi Elementary, Enchanted Lake Elementary, Kailua Elementary, Kailua HS, Kailua Intermediate, Kalaheo HS, Lanikai Elementary/Kaohao School, and Maunawili Elementary) and,
WHEREAS in 2020 and 2021 the eight previously designated Kailua shelters were all “evaluated” and deemed to be below standards by Honolulu Emergency Management, resulting in zero designated hurricane shelters in Kailua, and,
WHEREAS Climate Change is expected to impact hurricanes in Hawaii resulting in more destruction due to stronger winds, higher storm surges, and record rainfalls resulting in flooding, and,
WHEREAS The National Weather Service lists storm surge as often the greatest threat to life and property from a hurricane, and
WHEREAS Kailua is a Coastal Community, just 16 feet above sea level, vulnerable to storm surge-induced flooding, and
WHEREAS Kailua’s population of 40,516 (2020 Census) largely reside in single-wall structures located in areas prone to flooding or storm surge inundation – i.e. Beach Front Properties, Kawainui Canal, Hamakua and Kawainui Marshland, Kaelepulu Pond, and Enchanted Lake;
NOW AND THEREFORE be it resolved that the Kailua Neighborhood Board #31 requests our City, State, and Federal elected officials to obtain CIP funding for retrofitting/hardening previously designated Kailua hurricane shelters located outside of the flood zone – Kalaheo High School and Kailua High School, and,
BE IT FURTHER RESOLVED that such funding for construction projects at Kalaheo High School and Kailua High School shall meet the State of Hawaii Structural Guidelines for Hurricane Evacuation Shelters to address this unmet need.
